Este trecho \u00e9 respons\u00e1vel por grande parte dos acidentes automobil\u00edsticos naquela rodovia, muito deles fatais, atualmente sob concess\u00e3o da OHL Brasil. <\/p>\n<p>As obras correspondentes ao trecho por dentro da serra do Cafezal est\u00e3o paralisadas desde fins de maio do corrente por decis\u00e3o do Ibama que cassou a Licen\u00e7a Pr\u00e9via emitida em 2002 para as obras alegando que o projeto original havia sido substancialmente alterado . <\/p>\n<p>Em conseq\u00fc\u00eancia, o processo de licenciamento ambiental voltou \u00e0 estaca zero, fato este que obrigar\u00e1 a concession\u00e1ria a retardar sine die as obras de duplica\u00e7\u00e3o daquele trecho da rodovia. <\/p>\n<p>Desde 2002 a libera\u00e7\u00e3o das obras de duplica\u00e7\u00e3o da BR 116 vem esbarrando em liminares e decis\u00f5es judiciais provocadas por a\u00e7\u00f5es infundadas de entidades ambientalistas radicais sob o argumento de que a \u00e1rea da Serra do Cafezal \u00e9 zona de mata atl\u00e2ntica e, portanto, intoc\u00e1vel. <\/p>\n<p>Enquanto isto, a todo momento vidas tem sido ceifadas, merc\u00ea as condi\u00e7\u00f5es enfrentadas pelos usu\u00e1rios que s\u00e3o obrigados a trafegar perigosamente naquele trecho da estrada considerado tamb\u00e9m como um dos maiores gargalos do tr\u00e2nsito nas rodovias do Estado. <\/p>\n<p>\u00c9 de causar esp\u00e9cie, aliado tamb\u00e9m a um sentimento de revolta, a insensibilidade daqueles ambientalistas e das autoridades federais com rela\u00e7\u00e3o a este problema que j\u00e1 perdura. O Ibama, por exemplo, ao inv\u00e9s de obrigar a concession\u00e1ria e o Poder Concedente, o Gov\u00earno do Estado de S. Paulo, a paralisar as obras e a reiniciar todo o processo de licenciamento poderia simplesmente ter se reunido com os respons\u00e1veis pela obra e solicitado as interven\u00e7\u00f5es que julgasse necess\u00e1rias para o prosseguimento daquela obra, de vital import\u00e2ncia tamb\u00e9m para a liga\u00e7\u00e3o de S\u00e3o Paulo para o sul do Brasil. <\/p>\n<p>De quem afinal teme o Ibama? Da rea\u00e7\u00e3o daqueles \u201cvalentes\u201d e est\u00fapidos ambientalistas ou do Minist\u00e9rio P\u00fablico que certamente, se bem informado, n\u00e3o se furtaria a aprovar aquela obra.
